Hiring Your First Employee in Bulgaria: The Legal and Operational Handover

A practical guide to coordinating legal documents, HR responsibilities and payroll before your first employee starts work.

By Lachezar Vesov, Attorney at Law, Sofia Bar Association

A first hire in Bulgaria can involve a founder in one country, a manager in another, a local payroll provider and an employee waiting for a start date. Each person may complete their own task while an important handover remains unassigned. The practical challenge is to make the legal documents and the operating process describe the same job.

Before issuing final documents or promising a start date, create a short hiring brief. It should identify the employing entity, the person authorised to approve the hire, the role, the intended working location and the proposed pay arrangements. Record open questions instead of allowing assumptions to become instructions.

Start with the employing arrangement

Identify which entity will employ the person and who will sign for it. A founder's preferred contracting model should be reviewed against how the person will actually work. If a foreign entity, cross-border working or a proposed contractor arrangement is involved, raise those facts at the beginning of the legal and payroll review.

Translate the role into usable documents

Give the legal adviser a real description of the work, reporting line and proposed schedule. Include any remote-working arrangements, variable pay, confidentiality requirements and access to customer information. A template taken from another country may leave questions that the local team needs to resolve before it can implement the arrangement.

The practical test is whether the manager, the employee and the payroll provider understand the same terms. Resolve differences before signature, and keep an identifiable final version of each document.

Give every handover an owner

Use a checklist with a named owner and a completion record for each item:

  • Hiring approval and confirmation of signing authority.
  • Legal review of the employment documents and proposed working arrangements.
  • Confirmation of applicable registration and reporting steps with the responsible adviser.
  • Payroll setup and the information needed to calculate the agreed pay.
  • Equipment, system access and the manager's first-week plan.
  • A controlled location for employment records, with access limited to the people who need it.

This checklist is a coordination tool, not a complete statement of an employer's legal obligations. The required steps depend on the employing arrangement and the individual circumstances.

Check readiness before the first day

For example, a signed document may specify one start date while the payroll provider has been given another. The hiring team should reconcile the dates and confirm completion of the necessary steps before work begins. This is an illustrative scenario, not a reported client case.

For legal review, prepare the hiring brief, draft contract, job description and relevant policies together. Lachezar Vesov advises Bulgarian and foreign employers on employment documents, workforce changes and employment disputes; his professional site explains the scope of that work.

Keep the process usable after recruitment

Assign responsibility for probation-related reviews where applicable, changes to the role, leave administration and eventual offboarding. A good handover gives the manager a working process and a clear route for questions, rather than leaving the employment documents in an inbox.
